Terms & Conditions The Portuguese Band of San Jose (P.B.S.J.) hereby rents the __________, located at 100 North 27 th Street, San Jose, CA 95116, on the day of __________ of __________ from __________ to __________ to be used for a __________ approximately _____ guests for the sum of $_____. Renter also agrees to pay the cost of security which will be provided by uniformed police officers from the San Jose Police Department at the rate of $_____ per hour each officer (a minimum of 2 officers required at every event). The Portuguese Band of San Jose requires a security deposit of $_____ which will be refunded to the renter within 30 days after the event if the premises are returned in acceptable condition. Any extra cleaning expenses due to the negligence or misconduct of the renter or their hired help or invited guests, will be deducted from the security deposit. To confirm a date a deposit of $_____ must be received at the time of signing of the contract, the remaining balance including security deposit and police shall be paid at least 15 days prior to the date above. If the renter for any reason cancels the reserved date and the hall cannot be rented for the same date, renter will forfeit the rent deposit. ALCOHOLIC BEVERAGES must be acquired from the bar except __________ during the banquet. All beverages including soft drinks must be consumed inside the building. Any damage to the building or its contents must be paid by the renter. The use of nails, tacks and any type of tape or other defacing materials is prohibited inside the building. P.B.S.J. must approve all decorations in advance. P.B.S.J. abides by all state laws, therefore SMOKING IS NOT PERMITTED inside the building. The renter is responsible for notifying all guests of this in advance. Evidence of smoking inside the building will be cause for immediate forfeiture of security deposit. Renter agrees to indemnify and hold harmless the Portuguese Band of San Jose, its Officers, Directors and employees against any and all claims, cost of defending, loss and expenses incurred by reason of injury to any person or property on the premises or adjacent neighboring properties of any person whomsoever, occasioned by or arising out of the following: (a) any act of omission of the renter, or anyone holding the premises as for the renter or any of the renter's invited guests. (b) any use, activity or occupancy of the premises and parking lot during the rental period. Renter accepts and agrees to accept the current state and conditions of the premises and/or parking lot during the rental period as his/her total liability. In the event of the renter's failure to comply with the terms of this agreement, renter shall pay all reasonable attorney's fees and costs of any lawsuit. |
